Membership Agreement – Terms and Conditions
This Membership Agreement (“Agreement”) must be completed by the student or, in the case of minors under 18 years of age, by a parent or legal guardian.
By submitting this Agreement electronically, the member acknowledges that they have read, understood, and voluntarily agreed to all terms and conditions outlined below.
This Agreement is governed by and interpreted in accordance with the laws of the State of California.
1. Communication and Required Written Notice
All requests to cancel, suspend, or modify a membership must be submitted in writing with a minimum of 30 days’ advance notice.

Written notices delivered in person or sent via certified mail are also accepted.
2. Payment Authorization and Fees
By submitting this Agreement, the member authorizes Marinho Jiu-Jitsu, Inc. / Napa Valley Martial Arts & Wellness (NVMAW) to automatically charge the credit card on file on the first day of each month for all applicable membership dues and fees.
The member agrees to pay, when applicable:

Registration fee
-
Prorated dues based on start date
-
Required uniform items (gi, belt, rash guard, etc.)
All membership dues, fees, and registration payments are non-refundable.
Monthly Membership Rates
-
Adults: $200/month + $200 registration
-
Youth: $150/month + $150 registration
-
Kids: $150/month + $150 registration
A valid credit card must remain on file at all times.
Late payments may incur a $25 late fee.
If a member cancels and later returns, a new registration fee will be required.
3. Credit Card Disputes
Members retain all rights under the Fair Credit Billing Act.
Before initiating any dispute with a card issuer, the member agrees to:

Notify Marinho Jiu-Jitsu, Inc. in writing of any billing concern, and

Allow reasonable time for the organization to review and resolve the issue.
Credit card disputes submitted without prior written notice, or disputes involving properly authorized charges, may result in administrative fees as permitted under California law.
4. Uniform Policy
A proper Brazilian Jiu-Jitsu gi is mandatory for all gi classes.
Gis from other academies or affiliations are not permitted inside the academy.
Uniform compliance is required for participation in class.

5. Membership Term, Renewal, and Holds
Memberships automatically renew on the first day of each month.
Cancellations
Cancellations require 30 days’ written notice sent to:

To avoid the next billing charge, written cancellation notice must be received at least 30 days prior to the next billing date.
Holds
Members may request a temporary membership hold in writing.
All holds include:

A $50 monthly maintenance fee

Suspension of training privileges

Suspension of spectator privileges until reactivation
Any changes to membership rates will be communicated at least two billing cycles in advance.
6. Health, Safety, and Code of Conduct
Marinho Jiu-Jitsu, Inc. reserves the right to deny participation or immediately terminate a membership for:
No refunds will be issued in cases of disciplinary termination.
Academy Conduct Rules

No shoes on the mats
-
No food or drinks on the mats

Proper attire and hygiene are required

Families must remain silent around the mat area and avoid disruptions

Students may not use equipment during class unless instructed
7. Medical Authorization and Emergency Care
The member affirms that they are physically and mentally fit to participate in training.
In the event of an emergency, the member authorizes Marinho Jiu-Jitsu, Inc. to obtain emergency medical assistance if deemed necessary.
The member agrees to be financially responsible for:

Ambulance services

Medical treatment
-
Any related expenses
Marinho Jiu-Jitsu, Inc. is not responsible for the adequacy, outcome, or results of emergency medical care.
8. Assumption of Inherent Risks in Jiu-Jitsu
The member acknowledges that Brazilian Jiu-Jitsu, self-defense training, conditioning, and sparring involve inherent risks, including but not limited to:

Sprains, strains, fractures, and concussions

Joint dislocations, muscle tears, nerve damage
-
Chokes, locks, takedowns, and falls
-
Emotional or psychological stress
-
Property or financial loss
-
Permanent disability, paralysis, or death
The member voluntarily assumes all inherent risks, including those arising from training partners.
9. Liability Waiver and Release
In consideration of participation, the member releases and holds harmless:

NVMAW

Carlson Gracie Napa Valley

All owners, directors, instructors, employees, contractors, agents, volunteers, representatives, and property owners
from any liability for injuries or damages arising from:
to the fullest extent permitted by California law.
10. Indemnification
The member agrees to indemnify and hold harmless Marinho Jiu-Jitsu, Inc., NVMAW, and all affiliated entities from any claims arising out of:
except where prohibited by California law.
11. Media Release
The member grants permission to Marinho Jiu-Jitsu, Inc. to use their name, image, voice, and likeness for promotional, educational, and marketing purposes without compensation.
12. No Guarantee of Safety
Marinho Jiu-Jitsu, Inc. makes reasonable efforts to maintain a safe training environment but cannot eliminate all risks.
The member acknowledges that martial arts training is physically demanding and inherently dangerous.
13. Final Acknowledgment
By selecting the agreement checkbox and submitting this form online, the member affirms that:

14. Minors Under 18 Years of Age
For minors, the parent or legal guardian affirms that:

They agree to all terms on behalf of the minor, to the fullest extent allowed by California law
Electronic Signature
